A woman is suing Subway Restaurants Inc. and and other subsidiaries over the amount of meat her Steak & Cheese sandwich had on it, calling it “false and misleading” advertising.
Anna Tollison of Queens filed her lawsuit against Subway in the Eastern District of New York on Monday on behalf of anyone who bought a Steak & Cheese sandwich in the state between Oct. 28, 2021 and the date she filed the lawsuit, Law and Crime reports.
She claims in the lawsuit that “Subway materially overstates the amount of meat in its advertisements for the Product by at least 200%.”
Tollison points to several posts on social media with pictures showing people complaining about the amount of meat on various sandwiches. She says Subway’s actions are “especially concerning now that inflation, food, and meat prices are very high and many consumers, especially lower income consumers, are struggling financially.”
She claims that she purchased a Steak & Cheese at a Subway restaurant in Jamaica, New York for $7.61 on Aug. 23 based on the photos of the sandwich shared on the company’s mobile app.
“After she picked up and began eating her sandwich, Plaintiff realized that there was barely any steak in the sandwich and that the photographs that she relied on were grossly misleading,” the lawsuit claims.
“Plaintiff expected that the Steak & Cheese sandwich that she ordered would contain a similar amount of meat as contained in the photograph for the Steak & Cheese sandwich on Subway’s mobile ordering application,” the lawsuit continues.
“However, the photograph for the Steak & Cheese sandwich on Subway’s mobile ordering application contained well over 200% more meat than what was in the actual sandwich that Plaintiff received.
“If Plaintiff knew that the Steak & Cheese sandwich contained substantially less than the amount of meat as advertised, she would not have purchased said sandwich.”
She and her attorneys claim Subway violated the New York Deceptive Acts and Practices Act and are seeking unspecified damages.
Her attorneys from The Russo Firm have filed similar lawsuits in the same court against McDonald’s, Wendy’s, Taco Bell, and Burger King. The McDonald’s, Wendy’s, and Taco Bell lawsuits were thrown out by the courts. The Burger King lawsuit is still pending.
Subway has previously been sued over whether the tuna in their sandwiches is actually real tuna, or even fish, as well as claims that its “footlong” sandwiches are too short.
